Given that Ben Bishop has a NMC/NTC, can he be selected by Seattle in the expansion draft?

With his NMC, Ben Bishop must be protected for expansion, which means that Seattle cannot select him. However, Bishop could agree to waive his NMC for the purposes of the expansion draft, in which case Seattle would be able to select him.
